Terms and Conditions

Jet Ski and Kayak Rental Policy

Life Vest

  • Life jackets/personal flotation devices (PFDs) are provided in the following sizes:

  • Adult: 90 lbs and up

  • Youth: 50–90 lbs

  • Child: 30–50 lbs

  • All renters and passengers must wear a properly fitted and secured life jacket at all times while operating or riding on a jet ski or kayak, unless specifically instructed otherwise by TC Water Adventures staff.

  • Life jackets must remain properly secured throughout the rental period.

Operators and Age Requirements

  • Jet Ski Rentals

  • Minimum age to rent a jet ski: 21 years old.

  • Two forms of ID a credit card and a valid government-issued photo ID is required.

  • The renter must provide any required boating/safety certification before operating the watercraft.

  • Operators under 26 years old are recommended to complete an approved boating safety course prior to operating a jet ski.

  • Approved boating safety courses may be found through BoatUS Foundation.

Renters Under 21 & Chaperone Requirement

  • Individuals under 21 years of age are not permitted to independently rent a jet ski. TC Water Adventures may, at its discretion, allow an individual under 21 to participate in a jet ski rental when accompanied and supervised by a TC Water Adventures-approved chaperone.

  • A $75 chaperone fee will apply when a TC Water Adventures chaperone is required.

  • The chaperone fee is non-refundable once the reservation has been confirmed.

  • The TC Water Adventures-approved chaperone is responsible for providing the required supervision and safety oversight during the rental. The chaperone requirement does not eliminate the renter/operator's responsibility to comply with all applicable boating laws, safety requirements, capacity restrictions, and TC Water Adventures policies.

  • TC Water Adventures reserves the right to determine whether an individual under 21 may participate, whether a chaperone is required, and whether the rental can be safely conducted.

  • TC Water Adventures may refuse or cancel a reservation if the required chaperone is unavailable or if the renter does not meet applicable safety, identification, certification, or other requirements.

  • The renter is responsible for ensuring that all operators meet applicable age, licensing, certification, and legal requirements.

  • TC Water Adventures reserves the right to verify identification and required safety certifications before allowing any person to operate a watercraft.

CAPACITY REQUIREMENTS

Jet Ski

The maximum passenger configuration is:

Max weight of 490 lbs

Two adults

Two adults and one child

One adult and two children

The operator is responsible for complying with all posted manufacturer capacity requirements and instructions provided by TC Water Adventures.

Kayaks

TC Water Adventures offers both sit-in and sit-on-top kayaks.

Maximum weight capacities:

Sit-In Kayak: 250 lbs

Sit-On-Top Kayak: 450 lbs

Kayak Seating Arrangements

Single

Tandem (double), not exceeding a combined weight of 450 lbs

Tandem with one small child or pet, provided the total weight and kayak capacity are not exceeded

TC Water Adventures reserves the right to refuse a seating arrangement that it determines to be unsafe or exceeds the manufacturer's capacity.

SECURITY DEPOSIT

  • A refundable $250 security deposit is required for each applicable rental and will be authorized or charged to the credit card on file.

  • The $250 security deposit is not the maximum amount for which the renter may be responsible.

  • The renter is financially responsible for any loss, damage, destruction, recovery expense, or other costs resulting from the renter's or passenger's actions, negligence, misuse, violation of safety instructions, violation of these Terms & Conditions, or failure to properly operate or return the equipment.

  • TC Water Adventures is authorized to apply all or a portion of the $250 security deposit toward amounts owed. If the total cost of damage, loss, recovery, repairs, towing, transportation, staffing, cleaning, or lost rental revenue exceeds the $250 security deposit, TC Water Adventures reserves the right to charge the additional amount to the credit card on file and/or pursue the renter for any remaining balance.

  • The renter agrees that the security deposit does not limit their liability for damages or other charges.

DAMAGE & ADDITIONAL CHARGES

If damage or loss is incurred, TC Water Adventures may charge the credit card on file for the applicable amount.

Charges may be based on an assessment of actual or reasonably anticipated costs and may include, but are not limited to:

Actual repair costs

Estimated repair costs

Replacement costs for damaged or lost equipment

Mechanical inspection and diagnostic costs

Recovery of equipment

Recovery of passengers

Towing fees

Transportation costs

Staffing or labor costs associated with recovering or transporting equipment

Cleaning costs resulting from misuse or negligence

Lost rental revenue while equipment is unavailable

Any other reasonable costs directly related to damage, loss, misuse, or recovery of the equipment

TC Water Adventures may obtain an estimate, inspection, or professional assessment to determine the extent and anticipated cost of repairs.

If the final repair or replacement cost exceeds any initial charge or security deposit, the renter remains responsible for the additional balance.

INTOXICATION, ALCOHOL & DRUGS

For the safety of our customers, staff, and the public, TC Water Adventures has a zero-tolerance policy for operating or riding our equipment while impaired.

TC Water Adventures reserves the right to refuse service or cancel a reservation immediately if, in the reasonable judgment of TC Water Adventures staff, the renter or any person intending to operate the equipment:

Appears intoxicated or impaired;

Exhibits behavior or physical signs consistent with impairment;

Has the smell of alcohol or marijuana/cannabis;

Appears unable to safely operate the equipment;

Is in possession of or appears to be under the influence of an illegal drug; or

Otherwise presents a safety concern to themselves, passengers, staff, or others.

A reservation may be canceled before the rental begins if the renter appears intoxicated or impaired or if staff reasonably believes the renter is under the influence of alcohol, marijuana/cannabis, or another substance.

If a reservation is canceled or refused for any of these reasons, the renter will forfeit the full booking amount and will not be entitled to a refund, credit, or rescheduling.

TC Water Adventures' decision regarding whether a renter is fit and able to safely participate is final.

SAFETY REQUIREMENTS

Renters must arrive at least 10 minutes before their scheduled rental time.

This time is required to:

Watch the required safety video

Complete the required checklist

Receive the safety briefing

Review equipment and operating procedures

Address any questions or concerns before entering the water

Failure to arrive on time may result in a shortened rental period. The rental period will not be extended due to a renter's late arrival.

Renters must follow all instructions provided by TC Water Adventures staff, including instructions regarding restricted areas, bridges, shorelines, water conditions, speed, passenger capacity, and safe operation.

LATE ARRIVALS

Late arrivals will result in a shortened rental period.

The scheduled rental period begins at the reserved start time, regardless of when the renter arrives.

Late arrival does not extend the scheduled return time, and no refund or discount will be provided for time lost due to late arrival.

LATE RETURNS

Renters are required to return all equipment at the scheduled return time.

Late returns may result in additional charges, including applicable late fees and lost rental revenue when the late return affects another reservation.

Repeated or significant late returns may result in the renter being prohibited from making future reservations.

POLICY VIOLATIONS & CANCELLATION BY TC WATER ADVENTURES

TC Water Adventures reserves the right to cancel a reservation or terminate a rental at any time if the renter or passenger:

  • Violates these Terms & Conditions;

  • Fails to follow safety instructions;

  • Operates equipment recklessly or unsafely;

  • Exceeds the manufacturer's capacity requirements;

  • Enters a restricted or prohibited area;

  • Operates equipment while impaired;

  • Damages or misuses equipment;

  • Provides false or misleading information;

  • Fails to provide required identification or certification; or

  • Creates a safety risk to themselves, passengers, staff, equipment, or others.

When a reservation is canceled due to a renter's violation of these Terms & Conditions or safety requirements, the renter may forfeit the entire booking amount and may remain responsible for any applicable damages, fees, or other charges.

RENTER RESPONSIBILITY

The renter accepts responsibility for the equipment from the time it is released to the renter until it is returned and inspected by TC Water Adventures.

The renter agrees to operate the equipment responsibly, follow all safety instructions and applicable laws, and take reasonable care to prevent damage, loss, or injury.

By completing a reservation, the renter acknowledges that participation in watercraft activities involves inherent risks and agrees to comply with all safety requirements established by TC Water Adventures.

AGREEMENT TO TERMS

  • By making a reservation and/or participating in a rental with TC Water Adventures LLC, the renter acknowledges that they have read, understood, and agreed to these Terms & Conditions.

  • The renter further acknowledges that they are responsible for ensuring that all passengers and operators in their party comply with applicable TC Water Adventures policies and safety requirements.

  • TC Water Adventures LLC reserves the right to modify these Terms & Conditions at any time.

 Cancellations

  • Reservations are non-refundable unless otherwise approved by TC Water Adventures.

  • No-Shows

  • No-shows are charged 100% of the reserved rental amount.

  • A renter who has not arrived within 30 minutes of the scheduled rental time will be considered a NO-SHOW.
